No attorney–client relationship until we both sign
Reading this site, using the calculator, requesting a call, or calling the office do not create an attorney–client relationship. That relationship begins only when:
- the firm has completed a conflict-of-interest check; and
- both you and the firm have signed a written engagement letter defining the scope of the work.
Until then, please do not send us confidential or time-sensitive information, and do not rely on us to act on a deadline.
The flat fee and what it covers
The flat fee for The 4% Residence Trust is $2,495. It covers the custom irrevocable residence trust agreement, the South Carolina deed transferring one South Carolina property into the trust, attorney consultation and signing, deed recording handled by our office, and support with the county 4% legal-residence application as needed.
Recording fees and county charges are billed at cost and are not included. Additional properties are quoted separately. Work outside this scope — including tax planning, Medicaid planning, litigation, mortgage or lender negotiation, and matters concerning property outside South Carolina — is not included. Tax advice from the firm, if requested, is quoted separately.
This website does not start a trust online and does not take payment. Screening begins with a brief discovery call.
No guaranteed tax outcome
South Carolina’s 4% owner-occupied assessment ratio and the school-operating-tax exemption are administered by county assessors. Whether any property qualifies is determined solely by the county assessor, based on the facts and on the beneficiary’s actual occupancy of the property as their legal residence. The firm does not and cannot guarantee that any property will qualify, or that any particular amount of tax will be saved.
The savings calculator on this site is an illustration only. Millage rates vary by county, district, and year; the county figures used are placeholder averages; and other exemptions and credits are not modeled.
Third-party services
This site may use hosting and email-delivery providers to operate and to send messages you ask us to send. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
Your responsibilities
- Provide accurate, complete information if we later prepare documents for you. Documents drafted from inaccurate information may be ineffective.
- Tell us promptly about a mortgage on the property. Transferring mortgaged property raises lender-consent and due-on-sale issues that must be addressed before recording.
- Do not use this site to send unlawful content or to attempt to interfere with its operation.
